Subscriber Terms & Conditions
DESCRIPTION OF PRODUCT/SERVICE
The Mercury subscription provides access to:
- Membership to Incorporated Associated of The Mercury (trading as Mercury CX Incorporated) with all the powers and responsibilities included. See The Mercury constitution for full details
- Access to standard screenings programmed by The Mercury.
- Participation in Launch Lab & Script Club workshops programmed by The Mercury.
- Use of our screen making facilities (Writer’s Room, Sound Lab, Production Office, Equipment Hire)
- Eligibility to apply for the Quicksilver production initiative.
- Other exclusive benefits that The Mercury may offer from time-to-time.
- One off Single Day Guest Passes may be purchased at a cost of $25 per person per day for office spaces and $50 per person per day for production facilities spaces. Guests must be accompanied by a Subscriber at all times. Please see Mercury staff to arrange payment for Guest Passes.
METHOD OF SUBSCRIBING
Subscribers may enter a subscription online or in person at The Mercury’s front of house. Subscribers will agree to enter a 12-month subscription that can be paid for in advance in one lump sum or via 12 monthly direct debits (via Stripe). A subscriber will be required to complete a separate form for direct debit purposes. Subscribers will be issued with a subscription card. Lost cards will incur a $10 replacement fee. PRICE AND PAYMENT METHOD The price for a subscription is $25 monthly (GST inclusive) or $300 annually (GST inclusive). Subscription can be paid annually in advance upon sign-up. Payment can be made online via credit card or at the Front of House via efpos, cash or credit card. Subscription can be paid monthly via direct debit. Subscribers will need to enter into a direct debit agreement. The monthly fee will be deducted from a subscriber’s account on the 15 th of each month. LATE PAYMENT If a direct debit payment is dishonoured, The Mercury will advise the subscriber as soon as possible and the subscriber will be given the opportunity to honour the payment.
If consecutive direct debit payments are dishonoured by a period equal to or exceeding 3 months, The Mercury will enforce a Debt Collection Policy to recover the debt.
Access to the subscription services will be cancelled while a debt is being recovered and will be reinstated once the debt is settled.
A subscriber will be liable to pay any fee charged to The Mercury from a Debt Collection Agency who has been engaged to recover the subscriber’s debt.
PERIOD OF AGREEMENT
Subscribers will enter into a 12-month agreement. The agreement will automatically renew unless a subscriber gives 30 days’ notice in writing that they will not renew their annual
subscription.
CONDITIONS OF USE OF CINEMA SCREENINGS
A standard screening is a screening programmed by The Mercury. Externally programmed screenings, private hires or special events are not included in the subscription.
There is no limit to the number of standard screenings a subscriber may attend.
A subscriber can book standard screenings by an online booking system or at the Front of House upon presentation of their subscription card on a first come first served basis. While subscribers will be given preferential seating, there is no guarantee that subscribers will be reserved a seat for any standard screening unless it has been booked in advance.
Food and drink purchased at The Mercury Candy Bar can be taken into a standard screening.
Subscribers who enter a subscription will automatically become members of the Adelaide Cinematheque Film Society.
CONDITIONS OF USE OF LAUNCH LAB
A subscriber can book a workshop 14 days in advance via an online booking system or at the Front of House upon presentation of the subscription card.
There is no limit to the number of workshops that a subscriber can attend.
Any subscribers providing access to a non-subscriber will have their subscription suspended.
This includes entrance to the facilities.
Food and drink purchased at The Mercury Candy bar can be taken into the workshops.
The Mercury reserves the right to cancel or postpone a workshop.
CONDITIONS OF USE OF SCREEN MAKING FACILITIES
Access can be booked 28 days in advance via an online booking system.
The Mercury reserves the right to enforce fair use of the facilities and use its discretion to amend or refuse a booking during periods of high demand.
Access to the screen making facilities will be 24/7 provided The Mercury’s security system is operational.
Any access via a non-subscriber is strictly prohibited. Any subscriber providing a non- subscriber unauthorised access to the facilities by will have their subscription terminated.
The Mercury reserves the right to use its discretion regarding the use of the facilities by a non-subscriber.
Covert and overt CCTV cameras will be operational on a 24/7 basis and footage will be handed to the SA Police in the case of theft, damage, misuse or access by non-subscribers.
Children will not be granted access to the screen making facilities unless they are subscribers and are supervised by subscribers at all times.
Access to unauthorised or illicit websites is strictly prohibited (including pornographic, gambling and hate sites) and The Mercury has the right to randomly check website histories and offences will be reported to SA Police.
Downloading of pirated or illegal files or material from external websites is strictly prohibited and The Mercury has the right to randomly check the network and offences will be reported to SA Police.
Animals will not be granted access to the facilities unless they are medical assistance animals of subscribers.
A subscriber is expected to behave respectfully and politely while using the facilities and will be asked to leave if behaviour is disruptive or if the subscriber is adversely affected by drugs or alcohol.
A subscriber is expected to comply with all safety and administrative instructions given in writing and verbally regarding the use of the facilities.
A subscriber is not allowed to bring a bicycle into the facilities.
Non-subscribers who are visiting The Mercury’s facilities for an audition or to access the self-test booth must sign into the Visitor’s Register before accessing the facilities.
If a subscriber books the facilities and does not turn up more than 3 times without due cause, their subscription will be suspended until further notice. A subscriber will be liable to pay the call-out fee in the case where their activity in the facilities sets off a fire alarm.
Although The Mercury has facilities insurance, a subscriber will be liable for any excess in relation to an insurance claim for lost, stolen or damaged facilities booked by the subscriber.
Subscribers must not leave the facilities unclean or untidy and must place rubbish in the bins provided.
CONDITIONS OF USE OF SCREEN MAKING EQUIPMENT
Subscribers can use The Mercury’s screen making equipment by booking online and in advance.
Subscribers must return equipment to The Mercury at the conclusion of the booking period.
The Mercury reserves the right to use its discretion regarding the use of the equipment by a non-subscriber.
Equipment must be returned in the same condition and will be checked by The Mercury upon return.
Although The Mercury has equipment insurance, a subscriber will be liable for any excess in relation to an insurance claim for lost, stolen or damaged equipment hired by the subscriber.
TERMINATION OF AGREEMENT
These terms are effective until terminated by The Mercury, which The Mercury may do at any time and without prior notice to the subscriber.
The Mercury can terminate a subscription on the grounds of:
- Non-compliance with the terms
- Death of a subscriber
- Any other reason The Mercury deems appropriate
If a prepaid annual subscription is terminated by The Mercury prior to the completion of the subscription period, fees are not refundable.
A subscriber can pause a subscription for up to 3 months on the grounds of:
- Non-compliance with the terms
- Financial hardship
- Ill health
And will be required to give 1 month’s notice in writing that they wish to pause their subscription and provide reasonable evidence of the grounds on which the subscription will be paused. The Mercury reserves the right to use its discretion as to when the subscriptionwill be reinstated, or the pause period extended.
DISCLAIMERS AND WARRANTIES
A subscriber enters a 12-month subscription at their own sole risk.
The Mercury reserves the right to cancel or postpone services provided to subscribers.
The Mercury reserves the right to temporarily cease services on public holidays and during the official Christmas/ New Year holiday period during which The Mercury will be closed.
There is no warranty that the booking system on the website will meet your requirements or be available on an uninterrupted, secure or error-free basis.
The Mercury will not be liable for any loss of files/data whilst using our facilities.
The Mercury cannot guarantee that equipment and facilities will always be available even when booked due to circumstances out of our control.
There is no warranty regarding accuracy, timeliness, truthfulness, completeness or reliability of any content obtained through The Mercury website, or that this website is free of viruses or other harmful components.
The Mercury will hold public liability insurance.
GOVERNING RULES
These terms, and all related matters, shall be governed and interpreted by the laws of South Australia.
Any dispute under these Terms shall be subject to the exclusive jurisdiction of the Courts of South Australia.
RESOLUTION OF COMPLAINTS
The Mercury is committed to resolving complaints regarding The Mercury subscription. Please refer to our Customer Complaints Policy on our website which describes how we deal with customer complaints. By agreeing to and accepting these terms, you also agree to and accept the terms of our Customer Complaints Policy.
PRIVACY
The Mercury is committed to protecting your personal information. Please refer to our Privacy Policy on our website which describes how we collect and manage your personal information. By agreeing to and accepting these terms, you also agree to and accept the terms of our Privacy Policy.
MARKETING
A subscriber who enters a subscription agrees to receive a regular e-newsletter from The Mercury.
Any changes to these terms will be communicated to subscribers via a regular e-newsletter.
